I have purchased many ebooks in recent years, some with master resale rights, resale / reprint rights and many with giveaway rights.

A number of the ebooks have been acquired free of charge through various offers and forum memberships.

What I would like to know is: What is the legal position regarding the exchange or trade of the ebooks in my possesion, for ebooks which I do not have, offered by others.

I have never seen any restrictions mentioned regarding trading and exchanging reprint-rights. I accept many restrictions are placed upon the use of resale / reprint rights.


Publication must be sold at a set price (Is this legal?). Restrictive Price Practises.

Publication must not be included in a resell package.

Publication must not be given away.

Publication must not be sold on eBay or any other online auction.


At any given time in the future I would be most reassured if I knew I had the legal ownership and resell license rights to sell onwards any or all of the reprint rights I have in my possession.

Fear of legal action against me is a problem I face, and I guess the legal costs would deliver more problems.

I love the concept of digital information products. They provide information in a convenient form, and can be easily transported on my notebook, allowing access where and whenever I choose.

Sadly not all digial information products are equal. Some are a virtual waste of space and virtually a waste of time.

Most(if not all) frown upon trading or bartering one product
for another product or service. Especially if there are these
restrictions:

*Publication must not be given away.
*This product must be sold.
*You cannot give copies for FREE!

Since you are trying to trade or barter this would fall under
giving the product for free/not selling the product; and so,
would be a no-no.

You can always ask for clarification of rights/restrictions
from the creator of the product(s).

Nope, not legal... price fixing.

One can lose their resale rights licence if they don't sell for
a minimum price(depending on what the creator added to
the rights, they can revoke your rsale rights)

Trading and bartering may end up killing the resale rights
market even more than what's already happened with all
those undercutting each other on price...

Unless you have express rights to the product(It's yours
do antything with it, add it as a bonus, free giveaway rights,
etc.) I would be very wary of trying to trade/barter.

Again, the best recommendation would be to ask the product
creator of what you have and also the product creator of
what you want to trade/barter for - "is this allowed...?"

Price fixing is illegal in most locations according to my understanding. That's why I often issue a revokable license
instead of selling "rights." With a license you can better
control the terms and how your product is used.

Most of the things that I do and that many do is to protect the
value and integrity of the product. That's why most agreements
prohobit giving away the item (that makes it worthless to all
of the resellers who bought the rights with the intention of selling
the product). I view trading the item the same as giving it away
although some may disagree.

Differenent people offer reprint rights for varied reasons. Some
just want to get their viral product into as many hands as
possible, so they impose the fewest restrictions. Others
want to uphold the retail value so they issue fewer licenses
and set more restrictions. I did this with the license for my
workshop videos for example. I have a person who bought
one of my licenses last year who's earning $25,000 per month
from selling MY videos. He certainly wouldn't be able to do this
if everybody and his brother were selling them and competing
on the basis of price.
